WORK ON A PUBLIC HOLIDAY

Should an employee be required by his / her employer to work on any public holiday to which he / she is entitled to, he / she entitled to additional to the holiday pay for that day and regardless that the period of work is done on that day is less than the normal hours of work, an employee who is required by his / her employer to work on any paid holiday shall be paid as follow:-

1) in a case of an employee employed on a monthly, weekly, daily, hourly, or other similar rate of pay, be paid two (2) days' wages at the ordinary ate of pay; or

2) in the case of an employee employed on piece rates, be paid twice (2) the ordinary rate per piece.

If the employee is required to work for just one (1) hours on a public holiday, he must be paid the full two (2) days' wages at the ordinary rate of pay under Section 60D(3)(a) of the Employment Act 1955.

For any overtime work performed by an employee on a public holiday, the employee shall be paid as follow:-

1) in the case of an employee employed on a monthly, weekly, daily, hourly, or other similar rate of pay, be paid at a rate which is not less than three (3) times his hourly rate of pay; or

2) in the case of an employee employed on piece rates, be paid not less than three (3) times the ordinary rate per piece.

If an employee is required to work on a public holiday that falls on a half (1/2) working day, the ordinary rate of pay payable to the employee shall be that of a full working day.
